ELK GROVE UNIFIED SCHOOL DISTRICT V. NEWDOW, 542 U.S. 1 (2004)

This case was a challenge to the constitutionality of the phrase “under God” in the Pledge of Allegiance. Michael Nedow filed the lawsuit in an attempt to have the phrase removed from the pledge. Stepanovich filed two amicus briefs with the Supreme Court in support of “under God” in the pledge. The Supreme Court rejected the legal challenge holding that Newdow did not have legal standing to bring the case and reversed the federal appeals court ruling that declared the Pledge unconstitutional.
